Worker Left “Homeless” Following Divorce

A millionaire has stated that his divorce, which saw his wife obtain 80% of the family property, has left him too poor to get on the housing ladder.

A judge left David Stocker’s ex-wife with a property worth £1.8 million - more than seven times his £250,000 share, in a move which according to him, has left him unable to live.

“Unfair.”

The construction tycoon had a £1 million, west London home, a £100,000 yacht and a grand £500,000 villa in Spain. However, the vast amount of the properties had been left to his ex-wife.

Mr Stocker stated that he believed that the process was "unfair and disproportionate" especially as his former wife has no children to care for. Mr Stroker has since taken the decision to the Appeal Court, stating in the court that he has effectively been left homeless.

Mr Stroker, who represented himself in both Courts, said: "We have got no kids - why is it not 50/50?"

He told the judge: "My wife got a £1m house in Ruislip, half a villa that's worth hundreds of thousands more. My wife got £1.8m in property, and I'm left with £250,000.

"I'm entitled to a home under human rights. I told the judge throughout the case that all I wanted was a home out of it.”

He added: "The assets have 80 per cent gone her way. All I'm asking for is a home,"

No Ground For Appeal

Despite the appeal of Mr Stocker, the judge ruled that there was a limited ground for an appeal. The judge said: “Unfortunately, as happens so often in this type of litigation, everything here has the appearance of an applicant who refuses to have a sense of finality.

"This court doesn't sit as a re-hearing court. You don't just come here and say, 'Can we start all over again, please".

The judge added: "The husband argues that the division of the marital assets was unfair and disproportionate.

"This was a case in which there were no children to be taken into account, the husband contends that a 50/50 split would have been appropriate.

"But none of the matters he raises constitutes a basis for an appeal which has any prospect of success."

Mrs Stocker defended the payout from the divorce due to the fact that she had to work hard during the marriage to ensure that the family run business continued to operate during her marriage.

The case highlights the importance of having a prenuptial agreement or being able to some settlement prior to the court hearing. Although Mr Stocker had legal representation, he opted to represent himself. While a divorce may seem like it will be an even split, a case can quickly spiral out of control.
