The Court of Appeal has recently presided over a complex child custody case between a gay man and his lesbian ex-wife and partner, reports the Daily Mail.

The court heard that the man, who had previously been in a 'marriage of convenience' with the child's mother but was now divorced, had agreed to be a sperm donor for his ex-wife, who was in a relationship with a new partner. She subsequently gave birth to a baby boy.

The father was present at the birth of his son, who is now aged two, and was given five hours contact a fortnight. He now wants the right to be a full-time father.

This has been rejected by his ex-wife, who claims that there was clear agreement that she and her partner would be the primary carers for the boy, and that the father was to have only limited rights.

According to the Daily Mail, the Appeal court judges have reserved judgment to a later date.
