Increasing Use of Social Media Clauses in Prenups

There is a growing trend in the United States for couples to have clauses covering acceptable social media use built into prenuptial agreements, reports ABC News.

A prenuptial agreement is a written agreement that is generally used to allow couples, prior to marriage or civil partnership, to agree what will happen if they later separate, divorce, or have their civil partnership dissolved.

Social media clauses are now being added to protect the professional reputation of both partners, by setting out what is and is not acceptable for one partner to post online about the other.

They generally cover issues such as embarrassing photographs, or posts that might cause damage to a professional reputation, and will usually include a financial penalty to be paid by a partner who breaches the clause.

“It helps a couples identify the areas where they are never going to compromise,” explained Ann-Margaret Carrozza to ABC News. She is an attorney in New York, who has been involved in producing these clauses.  “You want to establish boundaries, what will be off limits, what will be private ... what are the acceptable areas of your private lives that you want to post online.”
